Privacy Policy For Ticket Buyers

This Privacy Policy describes the privacy practices of CinemaPlus, LLC (“CinemaPlus”, “we”, “our” or “us”) with respect to how we collect, use, disclose and share the information you provide when you complete a transaction through our services, including the CinemaPlus.com website and the CinemaPlus hosted service and applications used by exhibitors and web site operators (“Services”), or interact with our Services, email us or use any other communication that links to or references this policy. If a specific Service has an applicable privacy policy for such Service, then such privacy policy shall govern for that specific Service.

Before using or submitting information to the Services please review this Privacy Policy carefully, as well as the terms of service (the "Ticket Buyer Terms of Service"), available through our application and at cinemaplus.com, which governs your use of the Services.

The information that is received and collected is owned by CinemaPlus and/or the exhibitors or web site operators (collectively, the “Operators”) who utilize the Services and the use, handling and disclosure of your information will be governed by this Privacy Policy and the privacy policies, if any, of the Operators who utilize the Services.

  1. Information CinemaPlus Collects from Users

    There are two types of information we collect from users:

    Personal Information: Includes first and last name, phone number, email address, billing and/or physical address and zip code, location information, payment information and other demographic information that personally identifies you.

    Non-Personal Information: Information collected from your computer or mobile device that does not personally identify you. Examples of this information includes, but is not limited to, your IP address and device identifiers.

  2. How CinemaPlus Collects Information About You

    There are three ways your information can be collected:

    Information You Provide: We collect your information when you buy movie tickets via the Services, register for an account on a theater website for which CinemaPlus is providing Services to an exhibitor, sign up for email or text alerts, or contact us.

    Information Automatically Collected: We use cookies and other technologies to collect your information when you are using the Services. Please refer to our Cookies Policy below.

    Information from Third-Party Providers: We may obtain your information from third-party data providers, cookie technology operators, advertisers and other data companies. This information is obtained outside of your use of our Services and will not be subject to this Privacy Policy, but will be subject to the privacy policies of such providers, operators, advertisers and other companies.

  3. How CinemaPlus Uses Your Information

    We use your information to

    • Provide Services to you and complete your transactions;
    • Create your account for Services if you have registered for an account;
    • Respond to inquiries and provide technical support;
    • Monitor use of Services to continuously improve the customer experience;
    • Administer subscription and loyalty programs:
    • Deliver targeted advertising;
    • Conduct or participate in market research; and
    • Protect the security of our Services.
  4. How CinemaPlus Shares Your Information

    CinemaPlus shares non-personally identifiable data collected about your use of the Services with third parties and you consent to such sharing. We also share the information you disclose under the following circumstances, without limitation and you consent to such sharing:

    CinemaPlus Affiliates: When you supply information during use of our Services, CinemaPlus collects your information and it can be shared by CinemaPlus with each of its affiliates. Please refer to the individual privacy policies for additional information for our affiliates or specific Services, as applicable.

    Theaters and Venue Operator: The information collected by CinemaPlus (including personally identifiable information (for example, movie ticket purchases) and non-personally identifiable information) may be provided to exhibitors so that they can authorize admission to specific movie theater locations for movie show times, handle attendance related issues and administer exhibitor loyalty programs.

    Media Companies: Non-personally identifiable information collected by CinemaPlus, in the form of aggregate data, may be provided to movie studios and media companies for the purposes of compiling data regarding moviegoer trends.

    Service Providers (e.g., Stripe): CinemaPlus contracts with service providers to perform certain business-related functions on our behalf in order to provide the Services to us and to provide the hosted Services to exhibitors. For example, payment processing transactions for movie ticket purchases or loyalty subscription programs are conducted through Stripe. Certain information collected by Stripe may be shared with us and the exhibitors. Other examples include service providers that provide loyalty program administration, research, analytics, website hosting, database maintenance, and technology services and platforms. We share personally identifiable information with service providers on a need-to-know basis only restricting the information shared to only that which is needed to perform the specific services.

    Social Media: From your interaction with our Services, you may allow us to have access to information on one or more of your social media profiles or social media networks. When you supply information from one or more of your social media accounts, we may use the information to deliver you specific content, customize your online experience, and send you news, special offerings and rewards. When you provide us information through social media, it may be available for the public to view including other members of these social media networks which may result in your information being accessed and used by other third parties.

    Sale of CinemaPlus or its Assets: CinemaPlus may sell or purchase assets during the normal course of business. In the event that another entity acquires CinemaPlus or any of our assets, your information may be transferred to that entity. In the event of bankruptcy, reorganization or other creditor relief process, your information will be treated like an asset and may be sold or transferred to another entity or third party as a result of such bankruptcy, reorganization or creditor relief process.

    Legal Process: CinemaPlus will comply with requests from public authorities, including to meet public safety, national security or law enforcement requirements, and will supply your information related to these matters or in connection with an investigation.

  5. Childrens Use of Services

    The Services are not intended for children under the age of 13 and we ask that individuals under the age of 13 do not attempt to use Services or provide CinemaPlus with information. Should information be collected inadvertently from an individual under the age of 13, reasonable efforts will be implemented to dispose of this information.

    Minors under the age of 18 that reside in California can request deletion of information collected during use of Services as set forth in the section entitled “California Residents” below.

  6. How CinemaPlus Protects Your Information

    Any account information and password generated using the Services should be protected and kept secure. Do not disclose your password to others. Please notify us immediately if you believe there has been an unauthorized use of your account.

    CinemaPlus protects personally identifiable information you have provided when using the Services. Physical, technical and administrative safeguards have been put in place to prevent loss, mistreatment and unauthorized access or disclosure of information. Because no transmission of data or any safeguards used by CinemaPlus can ever be completely secure, any submission of personally identifiable information to CinemaPlus is made at your own risk.

  7. Your Rights and Choices

    User Consent: By using our Services, you are consenting to the Privacy Policy and acknowledge and agree that any disputes or claims you may have against or related to CinemaPlus regarding this Privacy Policy will be resolved in arbitration as set forth in the Ticket Buyer Terms of Service. You also are acknowledging and agreeing to give up your right to have your claim heard in a court by a judge or jury as well as your right to file claims on behalf of anyone but yourself and your family.

    Opt-Outs/Communication Preferences/Unsubscribe: You may elect not to receive marketing communications from CinemaPlus, your selected exhibitors and our partners when your information is being requested. You can change your communication preferences, change or delete your personal information or close your account by

    Location Information: You will need to opt-in when prompted to allow us to collect real-time location information for use of our Services with your mobile device. CinemaPlus may then use that location information to provide real-time information about theaters near you and their show times. If you wish to opt-out of sharing your location data, you can manage your preferences or disable the GPS on your mobile device.

    Cookies Policy: CinemaPlus uses different types of cookies in connection with our Services. We reserve the right to change our use of cookies from time to time. We will notify you of such changes by posting the revised version to this Privacy Policy.

    Cookies are small text files that are stored on your computer or mobile device. They are widely used to make websites and applications work, or work in a better, more efficient way. They can do this because websites can read and write these files, enabling them to recognize you and remember important information that will make your use of a website or application more convenient by remembering preference settings.

    CinemaPlus will use cookies that allow us to collect information such as browser type, time spent using our Services or time spent on a specific theater's website, pages visited, language preferences, navigation path and movies browsed. The following types of cookies are used by our Services.

    1. Service cookies: these cookies store the user's session ID which is integral for basic eCommerce functionality and keeping track of a user and shopping cart between page views. Service cookies enable you to move around a website or application and use its services and features. We use the information these cookies obtain to facilitate navigation, remember you when you come back to a theater site for which we provide Services, display information more effectively and for security purposes. Without such cookies, our Services may not perform as optimally as we would like them to and may not be able to provide certain services you request.
    2. Tracking and analytics cookies: We gather statistical information about the usage of our Services to continually improve the design and functionality, understand how customers use the Services and to assist us with resolving questions regarding the Services. These cookies allow us to see the overall patterns of usage through our Services enabling us to track and improve features based on behavioral analysis and metrics.
    3. Data profiling cookies-used to analyze your use of our Services (e.g., purchasing history) and to personalize your experience while using our Services, including making recommendations to you based on your use of the Services.

    Your cookies are collected by our Services and stored by a third-party service provider that we have retained to provide operating and data hosting services for CinemaPlus. The service provider is based in the United States and we have taken steps to ensure that this service provider protects the confidentiality and security of personal data, and to ensure that personal data is processed only for the provision of the Services and in compliance with applicable law.

    If you do not want information collected using cookies, there is a simple procedure in most browsers that allows you to decline the use of cookies. If you choose to decline cookies, then some or all the features, functionality and promotions available through our Services may not be available to you.   8. California Residents

    If you are a resident of California ("California Users"), in addition to the rights set forth in this Privacy Policy, you may have certain additional rights. You generally have the right to request information from CinemaPlus regarding the manner in which CinemaPlus shares certain categories of personal information with third parties for their direct marketing purposes. California Civil Code Section 1798.83 permits you to request information regarding the disclosure of your personal information by us to third parties for the third parties' direct marketing purposes. Under the law, however, a business is not required to provide this information if it adopts and discloses to the public (in its privacy policy) a policy of not disclosing customer's personal information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, as long as the business maintains and discloses this policy. Rather, the business may comply with the law by notifying California Users of their rights to prevent disclosure of personal information and providing a cost free means to exercise that right.

    California Users who are minors under eighteen (18) years old may request the removal of any information that they posted to a Service by contacting legal@cinemaplus.com. Upon such request, CinemaPlus will anonymize or remove from public view any content posted by a minor to a Service, unless required by law to retain such content or information.

    DO NOT TRACK DISCLOSURES

    CinemaPlus or its third parties may also use tracking technologies to collect information about your visits over time and across third-party websites or other online services. California Business & Professions Code Section 22575(b) (as amended effective January 1, 2014) provides that California Users are entitled to know how CinemaPlus responds to "Do Not Track" browser settings. CinemaPlus does not currently take actions to respond to Do Not Track signals because a uniform technological standard has not yet been developed. CinemaPlus continues to review new technologies and may adopt a standard once one is created.

  9. Changes to Privacy Policy

    We reserve the right to revise this Privacy Policy as needed. If material revisions are made to the Privacy Policy regarding how we collect or use your personal information, we will provide notice of those revisions through our Services, e-mailing you and/or by posting the revised version of this Privacy Policy online. Please check our Services periodically for updates.
